What is this warning?

The label is a warning being provided by Hale Industries, Inc. for our COOL-SPACE product line in order to comply with the California Safe Drinking Water and Toxic Enforcement Act of 1986; commonly known as “Proposition 65 (Prop 65).” Many products sold in California are required by law to carry the label. The following example label is included on our COOL-SPACE evaporative coolers and may be included on other COOL-SPACE products.

Why does COOL-SPACE include this warning on its products?

We are providing Prop 65 warning labels to inform consumers that the product contains chemicals on the State of California’s Prop 65 list. COOL-SPACE products that carry the Prop 65 label include components made with brass, which contains small but detectible amounts of lead—an element included on the Prop 65 chemical list. Brass has a long history of successful use in plumbing applications.

Even though a product may be found to contain a Proposition 65-listed chemical, it does not mean that use of the product will cause cancer, birth defects or other reproductive harm. Nor does it mean that a product is unsafe. All COOL-SPACE products meet or exceed the requirements of applicable product performance and safety industry standards, as well as the federal Safe Drinking Water Act.

What is California Proposition 65?

In 1986, California voters approved an initiative to address their growing concerns about exposure to toxic chemicals. That initiative became the Safe Drinking Water and Toxic Enforcement Act of 1986, better known by its original name of Proposition 65. Proposition 65 requires the State to publish a list of chemicals known to cause cancer or birth defects or other reproductive harm. This list, which must be updated at least once a year, has grown to include approximately 800 chemicals since it was first published in 1987.

Proposition 65 requires businesses to notify Californians about significant amounts of chemicals in the products they purchase, in their homes or workplaces, or that are released into the environment. By providing this information, Proposition 65 enables Californians to make informed decisions about protecting themselves from exposure to these chemicals.

Why is this label included on my COOL-SPACE product if I don't live in California?

COOL-SPACE products are sold both nationwide and internationally directly, online and through various distributors. It is impossible to determine which products will ultimately be sold to or brought into California. Therefore, to ensure compliance with Proposition 65 requirements, we have chosen to include these labels on all applicable products; regardless of where they might be purchased or sold.
